A Chicago homeowner who is a concealed carry holder pulled a gun during an altercation. The 43-year-old male victim was in front of his home when a verbal altercation broke out between him and three other men he knew.
The three men started attacking the homeowner, who then pulled his gun and fired in self defense.
A 29-year-old man in critical condition was struck five times in the torso, a 22-year-old man in critical condition was shot in the chest, and a 55-year-old man was struck in the neck and also in critical condition.
The homeowner ended up having blunt force trauma to the head and body and was transported to the hospital in critical condition.
In Illinois, where this self-defense shooting happened, disparity of force can make using lethal force more justifiable.
The courts will zero in on three main factors: the severity of the threat, your genuine belief that you were in imminent danger of death or serious harm, and whether that belief was reasonable.
Now you see why stand-your-ground laws are so important.
For the record, Illinois does not have a stand-your-ground law, so you are expected to try to retreat if it’s in public but not if it’s at your home.
